ICD Waterjet Inc - Terms and Conditions Agreement

This Terms and Conditions Agreement ("Agreement") is entered into by and between ICD Waterjet Inc, a manufacturing business specializing in waterjet cutting and laser cutting, and the user of ICD Waterjet Inc services ("Customer" or "You").
1. Acceptance of Terms
By accessing or using the services provided by ICD Waterjet Inc, including but not limited to the website located at www.ICDWaterjetLaser.com, contacting via phone at 619-477-1472, or engaging in business transactions, you agree to be bound by these Terms and Conditions.
2. Services Offered
ICD Waterjet Inc provides waterjet cutting and laser cutting services for various materials, including metals and other materials, as outlined on the website and discussed with the Customer. Specific details of services will be agreed upon in each individual transaction or contract.
3. Orders and Payment
3.1. Orders: All orders are subject to acceptance by ICD Waterjet Inc and may require a written agreement or purchase order outlining the scope of work, materials, pricing, and delivery terms.
3.2. Payment: Payment terms will be as agreed upon in the invoice or contract. Payments are due within the agreed-upon timeframe. Failure to make timely payments may result in additional fees or delays in service.

4. Materials and Specifications
4.1. Materials: ICD Waterjet Inc shall perform cutting services according to the specifications provided by the Customer. Any discrepancies or changes in material specifications should be communicated and agreed upon in writing.
4.2. Accuracy: While ICD Waterjet Inc strives for precision, slight variations in cutting dimensions may occur due to material properties or other factors. Reasonable tolerances should be expected and agreed upon between the parties.
5. Intellectual Property
5.1. Ownership: All intellectual property rights related to the services provided by ICD Waterjet Inc shall remain with ICD Waterjet Inc, unless otherwise agreed upon in writing.
5.2. Customer Material: The Customer warrants that they have the right to use any material provided to ICD Waterjet Inc and indemnifies ICD Waterjet Inc against any claims related to the use of such material.
6. Limitation of Liability
ICD Waterjet Inc shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the services provided, including but not limited to lost profits or business interruption.
7. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of California. Any disputes arising from this Agreement shall be resolved through good faith negotiations. If not resolved, they shall be subject to mediation or binding arbitration in accordance with the laws of California.
8. Miscellaneous
8.1. Amendment: ICD Waterjet Inc reserves the right to modify or amend these Terms and Conditions at any time. Any changes will be effective immediately upon posting on the website or other notification means.
8.2. Severability: If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain valid and enforceable.
